Contact Kelly Minnehan
Kelly R. Minnehan spent nearly all of her 19 years as an attorney in the service of California community college and K-12 school districts. In addition to acting as advisory and litigation counsel to California public education entities throughout those years, Ms. Minnehan spent a year as the Interim Director of Human Resources in a very large public school district, maintained a private practice dedicated to conducting investigations for public entity clients, and completed a contract as a Title IX Investigator/Ethics Compliance Officer / Complaint Resolution Officer for the University of California at San Diego.
As counsel, Ms. Minnehan routinely advises clients regarding compliance with the California Education and Government Codes as well as other state and federal laws and related regulations. She frequently investigates alleged violations of law and/or policy and issues reports directly to clients or to outside agencies.
Ms. Minnehan regularly addresses employment-related matters in the areas of discipline and dismissal (advisory work and hearings); alleged harassment, discrimination, and/or retaliation; failure to engage in the interactive process or denial of accommodation; and matters governed by the Ralph M. Brown Act, the California Public Records Act, and the Government Claims Act. She has conducted disciplinary hearings in a variety of settings, mediations, and hearings for certificated layoffs in cases ranging from 10 to upwards of 200 affected employees. She has also worked in the arena of labor negotiations up through declaration of impasse, represented a school district in arbitration regarding the interpretation of a provision of its collective bargaining agreement, and initiated litigation to nullify an illegal CBA provision.
Ms. Minnehan also has advised governing boards in open and closed meetings has attended as general counsel on personnel matters, student matters and as litigation counsel. She has supported governing boards by training their members as needed and district employees as well as drafting and revising Board policies and procedures.
Ms. Minnehan has represented clients in a variety of hearing or trial settings including California Superior Courts, United States District Court, the Office of Administrative Hearings, the Department of Industrial Relations/Division of Labor Standards Enforcement. She has also represented clients in matters before the Office for Civil Rights, the U.S. Department of Education, the California Department of Education, the Equal Employment Opportunity Commission, and the Department of Fair Employment and Housing.
Ms. Minnehan earned her Juris Doctor from the University of Georgia School of Law, her Master of Education from Salisbury University, and her Bachelor of Arts in English from the University of California at Irvine. She has been a member of various organizations including the California Counsel of School Attorneys, Lawyers’ Club, and the Association of Title IX Administrators.
